The LGPD,  General Data Protection Law, was sanctioned and begins to take effect from this Friday, 18/09/2020.

Inspired by the European model of the GDPR  (General Data Protection Regulation),    the LGPD regulates the policy of protection of personal data and privacy in Brazil, modifying some of the articles of the Marco Civil da Internet (previous law which  established principles, guarantees, rights and obligations for the use of the internet in Brazil ) and establishing new milestones for the way companies and public agencies treat the privacy and security of information of users and customers.

This means that, from now on, companies and public agencies will have to make it very clear to their users in Brazil how their personal data will be collected, kept and used.

Under the new rules, companies must obtain the consent of their customers for the use of their personal data. 

Failure to comply with the law may incur penalties that can reach up to 2% of the companies’ revenues, considered the limit of up to R$ 50 million.
